Divorce Law:

Separation and divorce from a spouse can be emotionally exhausting, and sometimes it is hard to keep perspective on your rights and responsibilities during your settlement process. As your Maine divorce attorney, we will always have your best interest in mind.

Through mediation, court filings and court hearings, we will secure your fair share of:

  • Child Support
  • Parental Rights and Responsibilities
  • Spousal Support and Alimony
  • Division of Assets
  • Division of Real Estate

Motions for Contempt and Enforcement of Existing Settlements

Maine divorce law stipulates that the terms of a divorce judgement can be enforced or changed if either party does not satisfy the terms of the arrangement. If you have already been through a divorce and your former spouse is behind on child support, spousal support, or is not following the terms of your settlement, we will:

  • Modify divorce judgment if there has been a change in circumstance
  • Modify child or spousal support if there has been a change in income or circumstances
  • Modify child custody arrangements
  • If any party is not following the terms of an existing judgement, we will file motions for enforcement and motions of contempt in issues of child support, visitation, property and asset division provisions, payment of spousal support and alimony, and issues to deal with real property

Protection from Abuse and Harassment

If you or anyone in your family is in need of legal protection from a former partner or spouse, we can help. While you should immediately contact law enforcement if you are in fear of danger or imminent harm, you should also seek a free consultation with one of our attorneys who has experience in securing protection from abuse or harassment orders. We can seek protection from abuse or harassment orders for you, or on behalf your minor children (including orders against dating partners).

We will assist you in securing a temporary protection from abuse court order, and prepare your case to fully represent you in a hearing before a judge for a permanent order.

Alternatively, we can negotiate a binding protection from abuse order with the other party, to avoid the stress and costs of a full testimonial and evidentiary hearing.

Ultimately, we will ensure that you have a court order in place that is customized to you and your unique situation (e.g. former partner workplace harassment, stalking, threatening behavior, etc.).

Grandparent Rights

Maine Law specifies that grandparents are entitled to visitation or access to their minor grandchildren under any of the following circumstances:

  • One of the child’s parents are legal guardians has died
  • The grandparent had an existing relationship with the child
  • The grandparent made an attempt to establish a relationship with the child

The Maine Grandparent Rights Law gives grandparents a legal avenue to seek access to grandchildren, but the court heavily weighs the opinions and desires of parents and legal guardians. If you are a grandparent seeking visitation with your grandchild, our family attorneys can help you throughout the legal process.

Maine Adoption Law

While there is no greater excitement than the thought of adding a child to a family, the realities of legally changing parental guardianship involves detailed paperwork that must be completed and served to appropriate parties in a timely manner. As your lawyers, we will make sure your adoption goes smoothly.

Our Family Law attorneys handle all Maine adoptions, including:

  • Open and closed adoptions from birth
  • Stepparent adoptions
  • Adoption of foster children
  • Termination of parental rights
